Flight delays at the airport

If your flight is delayed, passengers from Serbia are entitled to rights under EU Regulation No. 261/2004 of the European Parliament and Council, which also applies in Serbia through the Law on Contracts and Torts and the Law on Foundations of Property Law Relations, in accordance with the ECAA Agreement and the Regulation on passenger rights in cases of denied boarding, flight cancellation or long delays.

When are you entitled to compensation?
1. If your flight departs from an airport in Serbia or the EU, or arrives in Serbia or the EU, operated by Air Serbia or another EU-registered airline
2. If you arrived at check-in on time and the delay wasn’t due to extraordinary circumstances like severe weather, staff strikes, or security issues
3. If you were involuntarily denied boarding your flight
4. In the case of flight cancellation

If you arrive at your destination 3 or more hours later than the originally scheduled time, you are entitled to compensation:
• €250 for flights up to 1,500 km
• €400 for flights between 1,500 and 3,500 km
• €600 for flights over 3,500 km

If your flight was delayed for more than 5 hours, you are entitled to a refund for the unused portion of your ticket or a return to your point of departure as soon as possible if you choose not to continue your trip.

For delays before departure lasting 2 to 4 hours (depending on the flight distance), the airline must provide:
• Meals and refreshments appropriate to the waiting time
• Two free phone calls, emails, or faxes
• Hotel accommodation and transport to/from the hotel if the delay requires an overnight stay

Be sure to request a written document or Delay confirmation from the airline, as this will serve as evidence in future legal proceedings.
